The Friends of the Middlesex Fells Reservation learned last week that the Massachusetts Appeals Court had upheld the earlier action of the Superior Court, denying the claim that the Langwood Commons developers and the Department of Conservation and Recreation are violating MEPA by continuing the segmentation of the developer’s project. The Appeals Court decision was very brief, and the Friends were disappointed by the absence of a substantive evaluation of the facts in the case. At this point, a request for further appellate review by the Supreme Judicial Court is being prepared by the Friends to seek a more detailed consideration of the case.
